I applied on July2,got the receipt on Aug 22 nd.Got EAD,AP.
One strange thing is my case is NSC to CSC but still in CSC only .I think except my case,all others cases transfred back to NSC.I do not know the reason.
Any comments please....

SRC is always Texas , LIN is Nebraska. Also when you input the receipt number in USCIS case status website it tells you which center this application is with.
I understand that. What I wanted to know was what number you have? SRC or LIN? And also to confirm, if it was cashed by TSC? and not the case that it was cashed by NSC and then scheduled to be transfer to TSC?

In that case, I *guess* you can show yourself as "permanently self-employed" for your own company--should be easy if you have an LLC that does business in "same or similar" occupation (e.g., consulting/PM). Should also be easy to state the *projected" yearly income on EVL.

We are collecting pledges to file a lawsuit against USICS against these random and opaque processing of GC's. Our target is to get 1000 affected people to pledge atlaset $100 each so that we can fund this lawsuit. No money being collected right now..just honest pledges.

The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS

Then there are the people (incl Ombudsman) who say that such interim benefits (EAD AP) should not be granted to such large numbers of people without security checks etc.
My guess is that this is precisely why USCIS didn't want the all current situation. They don't want to be stuck with 700K applications which have no hope of getting a greencard for years upon years, while they churn out EADs and APs for all those years.
Of course, one fix would be to increase the EAD time period to 3 yrs. Something they have been unwilling to do.

Does anybody know how long one can stay out of Canada after landing? I heard some where its 2 years and some say its 3 years from the date you land.
And that time does not have to be continous. You can do cycle of 6 months in Canada 1 year outside outside and it will still count to 2 years by end of 5 years, or you can do just last 2 years of those 5 years.

For some postal destinations the USPS offers guaranteed 2 day service. I recently mailed a package where this service was offered. The postal worker explained that if the package was mailed on a Friday, it would be delivered on Sunday. San Francisco, CA is one of the destinations where this service is offered and the package in question was, indeed, delivered on a Sunday.
You should check whether the postal service offers the 2-day service to the USCIS office.

Don't make stupid statements like this. It goes to show your intelligence and that you are an instigator. With statements like that you will alienate EB3 more. BTW, I contributed to DC advocacy and many other EB3s also did the same. That money apparently seemed to have have helped EB2 and not EB3.

I am not sure your point will be taken seriously by anyone with this kind of language. If you didn't mean to be taken seriously, then well... you are right on point. So, why not concentrate on action items which unites us all, rather than dividing us, like VISA recapture, abolishing country quota, not using quota against dependents etc. Think about it.

Folks, here is what I am able to gather by self employment
(1) One can be self employed
(2) 1099 or w2 - kinda tricky - most people I talked to do w2 and any profits they get after they take their salary are bonuses
(3) The job has to be legitimate - in the same or similar category - you must be doing duties that are similar in nature to your 140 petition
(4) What is meant by legitimate is - you must simply not be doing "nothing" - there must be income and you must be doing your duties.

It looks like USCIS has indeed pre-adjudicated a lot of cases - if processing times at the various Service Centers are any indication, then the USCIS is almost done.
From now on, USCIS will be able to make a more accurate and realistic demand for visa numbers to the DOS. This means the dates will move forward gradually - with a measured jump in the last month of the last quarter.
For FY10, the jump in the last quarter will depend on:
1. State of the US Economy - If it continues to be L shaped, then less demand from EB2ROW and EB2I dates my advance up to mid 2006.
2. China EB2 - The faster it moves, the further EB2I will advance. It was suprising to find that EB2 China is back in 2005. Either the DOS has been really conservative or USCIS has truly done some house cleaning.
From now on, USCIS will be able to make a more accurate and realistic demand for visa numbers to the DOS. This means the dates will move forward gradually - with a measured jump in the last month of the last quarter.

If someone ports from eb3 to eb2 they should get the priority date of the day they were eligible to file an eb2 and not be able to carry the date from eb3.
Porting makes sense in a family based visa where your petitioner can file for an application while he is still a green card holder and then becomes a citizen which upgrades the beneficiary's category as well.
On an employment visa you file for an eb3 when you are eligible for an eb3 job, you file for an eb2 when you are eligible for an eb2 job. Why would you be able to jump ahead in the eb2 line when you were clearly did not have an eb2 job ? Just because you filed an application at some point of time in eb3 and waited a decade to get a better job doesn't mean someone else has to pay for your (pick one - laziness, ineptitude, lack of skill or lack of knowledge).
Most of IV Core is made of eb3 applicants and therefore there has never been any push from the core on this matter. And as someone said .. You ARE eating my lunch..
